Why you need a notary to buy property in Montenegro

In Montenegro every property sale must be certified by a notary (notar). Without notarial certification the contract has no legal force and cannot be registered in the cadastre. The notary checks the title documents, confirms there are no liens or encumbrances, verifies the identities of the parties and ensures the terms of the deal comply with Montenegrin law.

Notaries are distributed across municipalities (opština) — Podgorica, Budva, Bar, Kotor, Tivat, Herceg Novi and others. A notary operates throughout the country, but in practice it is more convenient to close the deal with a notary in the municipality where the property is located. In this directory you can filter active notaries by municipality and find their contacts, address and working details.

The notary tariff is fixed by the state and calculated from the official Tarifni broj 1 schedule — it does not depend on which notary you choose, so the deciding factors are location and language. VAT of 21% is added to the tariff. You can estimate the exact cost for a given property price in the deal-cost calculator.

Notary data is refreshed from the public records of the Notary Chamber of Montenegro. Before your visit we recommend calling ahead to confirm the list of required documents and reception hours.

Frequently asked questions

The notary verifies title documents and the absence of encumbrances, authenticates the identities of the parties, certifies the purchase contract, and ensures the transaction complies with the law. Without notarial certification the contract has no legal force and cannot be registered in the cadastre.

Yes. In Montenegro notarial certification of a real-estate purchase contract is required by law — without it ownership cannot be registered in the cadastre.

The notary tariff is fixed by the state under Tarifni broj 1 and depends on the property price, with 21% VAT added on top. The tariff is the same for all notaries. An approximate figure for a specific price can be calculated using the transaction cost calculator.

Typically required are the passports of both parties, a cadastre extract (list nepokretnosti) for the property, a draft purchase contract, and proof of payment of taxes and fees. The exact list is best confirmed with the notary in advance by phone.

The contract is drawn up in the Montenegrin language. If at least one party does not speak it, the notary is legally required to engage a sworn court interpreter who verbally translates the contract before signing. You can find an interpreter by language in our translators directory.
